Terms of Service

These terms establish the conditions for using Forky and contracting its services.

1. Acceptance of terms

These Terms of Service govern access to and use of Forky, a platform for managing, versioning, and collaborating on restaurant menus.

By creating an account, contracting, accessing, or using the service, you accept these terms, the Privacy Notice, and any policies published within the platform.

2. Account and security

Users must provide truthful, current, and complete information. The organization is responsible for managing users, roles, permissions, restaurants, branches, and menus.

Each user is responsible for keeping credentials confidential and for activity performed from their account. Unauthorized access or security incidents must be reported to soporte@forky.rest.

3. Service

Forky enables drafts, change tracking, version review, menu publishing, and team collaboration.

Some features may depend on third-party services such as authentication, storage, infrastructure, technical repositories, email, payments, or analytics.

4. Plans, payments, and cancellation

Plans, prices, billing frequency, applicable taxes, and features will be shown before contracting.

The free plan may be limited to one restaurant, one branch, and one menu. Paid plans may enable multiple restaurants, branches, and menus under the published conditions.

5. Permitted use

Users must use Forky only for lawful purposes related to their operation.

It is prohibited to compromise systems, access third-party information, bypass controls, introduce malware, perform unauthorized reverse engineering, or upload unlawful content.

6. Customer content

The organization keeps all rights over menus, images, text, prices, descriptions, files, and other content uploaded to Forky.

The organization grants Forky a limited, non-exclusive license necessary to host, process, back up, display, and transmit that content to provide the service.

7. Forky intellectual property

Forky, its software, design, interface, trademarks, documentation, components, code, and know-how belong to their owners or licensors.

These terms do not transfer intellectual property rights over the platform.

8. Confidentiality and data

Each party must protect the other's confidential information with reasonable care and use it only to comply with these terms.

Personal data processing is governed by the Privacy Notice.

9. Availability and support

We try to keep Forky available and secure, but we do not guarantee uninterrupted or error-free operation.

Support will be provided through available channels and according to the contracted plan, where applicable.

10. Limitation of liability

To the extent permitted by applicable law, Forky will not be liable for indirect, incidental, special, punitive damages, lost profits, business interruption, or data loss caused by misuse.

Nothing in these terms limits non-waivable rights that may correspond to a user or consumer under applicable Mexican law.

11. Suspension or termination

We may suspend or terminate access for breach of these terms, security risk, misuse, non-payment, authority request, or impact on other users.

The organization may stop using the service or cancel its subscription under the conditions of the contracted plan.

12. Governing law and jurisdiction

These terms are interpreted under the federal laws of Mexico.

Where applicable, rights under Mexico's Federal Consumer Protection Law and other applicable Mexican provisions will be respected.

13. Changes to terms

We may update these terms to reflect legal, operational, or service changes. Updates will be published on this page.
